It was a wide spread news that Apple had gone over to impose a ban on the sale of Samsung Galaxy tablet in Australian. The latest news that has hit the tech market is the incident of Apple seeking for a ban over the Samsung S3. Reports say that the case has been filed against Samsung and company will have to face it at the Australian Patent Office.
It was recently that Apple filed a violation of patent case against the Korean Company Samsung for having breached the user interface patent. The case was filed when the Samsung’s new phone was on its way to become a big hit in the Australian smart phone market.
The earlier patent war between the two companies was initiated in April 2011 and the heads of the two companies met recently in a court session in US to settle the issue over the patents. It was soon after this session by Tim Cooks, the chief executive of Apple with the Samsung head, that the new case has been filed. According to popular reports published in the Wall Street Journal, it has been stated that there are over 30 patent breach cases between the two companies.
The recent case is that which has been filed by Apple against Samsung in Australia with charges of competency on May 22nd. It is still not clear what Apple meant with its objection to competency case, but yet Samsung now faces the Australian Patent office over this case and its hearing.
Samsung has replied back to the case with the statement that Apple’s requests are without proper evidence and that they will prove that the company has not breached any patency rights or laws in the new Samsung S3 model. Samsung is all set to prove to the Australian court and the several other Samsung Android phone supporters that the phone is in no way punishable for patency laws. The company has claimed that they will prove that their new smart phone is a new and unique innovation in all sense.
In spite of all these issues, Samsung has stated that they will go on with the launch of the new phone into the global market on the proposed date and that there will be no delay or restriction in the release of its newest innovation in the US market too.
To all these commotion, the Apple company Spokesperson, Steve Park made clear its stand and the reason why they have filed cases over Samsung for its new phones. He stated that the latest Samsung models are more or less similar to Apple devices, not just in the looks but also in the hardware specification to even the minute details like the packaging too. The patent copyright gained by Apple will have to be saved to prevent any kind of blind copying of the company’s intellectual property. Apple has deposited the case with proper claims after having dissected a Galaxy S3 and finding that two patents have been clearly infringed.
